Workers subrogated from Telefónica Research and Development (TID) to Telefónica Innovación Digital, SLU in 2023 —known internally as the "R&D Collective"— now have a new compensation framework. The Resolution of October 15, 2026 from the General Labor Directorate registers and publishes the agreement that formally integrates them into the Collective Agreement of Global Units of Telefónica in Spain (GBUs Agreement), with a schedule of changes extending until 2029.
For HR departments and the affected workers themselves, the impact is immediate: there are complements that no longer grow, a seniority system that closes, and variable pay with an expiration date.
What does this regulation establish?
The agreement articulates the integration of the "R&D Collective" into the GBUs Agreement through a staggered schedule of changes. Below are all the modified elements:
| Compensation element / condition | Previous situation (TID engineering agreement) | New situation (GBUs Agreement) | Effective date |
|---|---|---|---|
| Agreement Bonus | Was accrued and updated | Is frozen and consolidated at current amount | 01/10/2026 |
| Personal Complement | Was accrued and updated | Is frozen and consolidated at current amount | 01/10/2026 |
| Seniority bonuses from the engineering agreement | New seniority bonuses were accrued without limit | Accrual of new seniority bonuses is eliminated; replaced by a fixed Seniority Complement with a cap of 9 seniority bonuses | 01/01/2027 |
| Productivity pay | In effect | Maintained until 2028; eliminated from 2029 | Elimination: 01/01/2029 |
| Collective and health insurance | Conditions of the TID engineering agreement | Now governed by the conditions of the GBUs Agreement | Immediate integration |
| Pension plan contributions | Conditions of the TID engineering agreement | Aligned with the conditions of the GBUs Agreement | 01/01/2027 |
The Seniority Complement that replaces seniority bonuses is a fixed amount with a maximum cap equivalent to 9 seniority bonuses. Those who already exceed that threshold will not see a reduction, but will not accumulate additional paid seniority either.
Economic and operational impact
Integration into the GBUs Agreement has concrete and progressive economic consequences for workers of the "R&D Collective":
- Freezing of complements (from October 2026): the Agreement Bonus and Personal Complement stop growing. Workers who were close to an increase in these items will not receive it.
- Closure of the seniority bonus system (from January 2027): the engineering agreement allowed accumulating seniority bonuses indefinitely. The new fixed Seniority Complement with a cap of 9 seniority bonuses limits compensation growth by seniority for those who had not yet reached that ceiling.
- Loss of productivity pay (from 2029): this pay remains intact during 2027 and 2028, providing a two-year transition margin. From 2029 it disappears permanently.
- Change in insurance and pensions (from January 2027): the conditions of collective insurance, health insurance, and pension plan contributions are aligned with the GBUs Agreement, which may result in variations in coverage and the level of employer contribution depending on the differences between both agreements.
From an operational perspective, HR departments must update payroll systems and insurance contracts to reflect changes on each effective date, avoiding incorrect accruals that generate contingencies in labor inspections.
Who does it affect?
- Workers of the "R&D Collective" of Telefónica Innovación Digital, SLU: people subrogated from Telefónica Research and Development (TID) in 2023 who maintained conditions of the engineering agreement.
- HR and Compensation departments of Telefónica Innovación Digital, SLU: responsible for implementing changes in payroll, insurance, and pension plan within the established timeframes.
- Labor advisors and unions that represent or advise workers of this collective.
- Financial management (CFO) of Telefónica Innovación Digital: the elimination of productivity pay from 2029 and the alignment of the pension plan have an impact on medium-term personnel cost planning.
Practical example
Imagine an engineer from the "R&D Collective" with 12 years of seniority at Telefónica Innovación Digital, SLU, who currently accumulates seniority bonuses under the engineering agreement and receives the Agreement Bonus, Personal Complement, and productivity pay.
- From October 1, 2026: their Agreement Bonus and Personal Complement are frozen at the amount they had on that date. There will be no new updates to these items.
- From January 1, 2027: they stop accruing new seniority bonuses under the engineering agreement. If they have accumulated 4 seniority bonuses, the new fixed Seniority Complement will recognize those 4 bonuses, but the maximum cap will be 9. Their pension plan contributions and insurance coverage are now governed by GBUs conditions.
- During 2027 and 2028: they continue to receive productivity pay under the same conditions.
- From January 1, 2029: productivity pay disappears from their payroll.
The net result is a progressive reduction in variable compensation and seniority complements, with the most significant impact arriving in 2029 with the elimination of productivity pay.
What should companies do now?
- Audit payroll of the "R&D Collective" with immediate effect: verify that the Agreement Bonus and Personal Complement are frozen from October 1, 2026, and that no increases have occurred after that date.
- Update the seniority system before January 1, 2027: configure the new fixed Seniority Complement with a cap of 9 seniority bonuses and cease accrual of new seniority bonuses under the engineering agreement.
- Review collective and health insurance contracts: coordinate with the insurer the transfer to the conditions of the GBUs Agreement for all workers of the collective.
- Align pension plan contributions before January 2027: communicate the change to the plan manager and update employer contribution amounts according to GBUs conditions.
- Plan the impact of the elimination of productivity pay in 2029: incorporate this cost reduction into 2029 personnel budgets and communicate the change to affected workers with sufficient notice.
- Document and file the agreement: keep the Resolution of October 15, 2026 (BOE-A-2026-22425) as support for possible claims or labor inspections.
