If you appear on the excluded list or do not appear on either of the two lists of the permanent labor personnel call from the Ministry of Defense, the clock is already running. The Resolution 430/38403/2026, published on October 3, 2026, approves the provisional list of admitted and excluded and opens the period to act.
The call, originally launched on July 1, 2026 through Resolution 430/38310/2026, covers positions for free access and internal promotion in the professional groups M3, M2, M1, E2 and E1, all of them subject to the IV Collective Agreement for labor personnel of the General Administration of the State.
What does this regulation establish?
The resolution approves the provisional list of admitted and excluded persons in the selection process and, at the same time, announces the date, time and place of the exercises. The key aspects are as follows:
Exercise modality by professional group
| Professional group | Type of exercise | Place of celebration | Province selection |
|---|---|---|---|
| M3 | First and second exercise | Madrid | Not applicable |
| M2 | First and second exercise | Madrid | Not applicable |
| M1 | Single exercise | Province to choose | Yes (modifiable during remedy) |
| E2 | Single exercise | Province to choose | Yes (modifiable during remedy) |
| E1 | Single exercise | Province to choose | Yes (modifiable during remedy) |
Remedy process
Excluded or omitted applicants must submit their remedy through the IPS service of the General Access Point (PAG) of the Administration. This is the only valid channel. Remedies are not accepted through other means.
After the final list
Once the final list of admitted and excluded is published, a period will open to file a claim before the Social Courts of Madrid for those who are not satisfied with their situation.
Mandatory material for the exam
Applicants must attend the exam with black or blue ink pen and valid identification document. The absence of either of these elements may make it impossible to take the test.
Economic and operational impact
For applicants, the most immediate impact is operational: the remedy window is short (10 business days) and the channel is unique (IPS of the PAG). A management error within this period is equivalent to being excluded from the process without the possibility of prior administrative appeal.
For applicants in groups M1, E2 and E1, the remedy period is also the only opportunity to change the exam province. Once this period closes, the province is fixed definitively. This has real logistical and economic implications: travel, accommodation and work permits depend on this decision.
For those who are not satisfied with the final list, the challenge route goes through the Social Courts of Madrid, which implies legal and representation costs if you decide to litigate.
Who does it affect?
- Excluded applicants from the provisional list in any of the five groups (M3, M2, M1, E2 or E1): must remedy within 10 business days or are excluded.
- Omitted applicants (do not appear in either admitted or excluded): must also act within the same 10 business day period.
- Admitted applicants for M1, E2 and E1 who wish to change their exam province: can only do so during the remedy period.
- Admitted applicants for M3 and M2: must prepare to take first and second exercise in Madrid on the announced dates.
- Internal promotion candidates within the Ministry of Defense: affected on the same terms as free access.
Practical example
An applicant for group E1 who submitted their application in July 2026 checks on October 3 that they appear on the excluded list due to a defect in the documentation provided. They have until the thirteenth business day from October 3 (approximately October 17, 2026, not counting national or local holidays) to access the IPS service of the General Access Point, remedy the defect and, at the same time, change their exam province from Madrid to Seville, where they reside. If they do not act within that period, they will be permanently excluded from the process and can only appeal to the Social Courts of Madrid once the final list is published.
An applicant for group M3 who appears as admitted does not need to do anything during the remedy period, but must keep in mind that their exam (first and second exercise) will be held in Madrid on the date, time and place published in the resolution, and that they must bring a black or blue ink pen and a valid identification document.
What should applicants do now?
- Check your status on the provisional list published in the BOE on October 3, 2026. Verify if you appear as admitted, excluded or omitted.
- If you are excluded or omitted, act before the 10 business days expire. Access the IPS service of the General Access Point (PAG) and submit the remedy with the documentation that corrects the indicated defect.
- If you are an applicant for M1, E2 or E1 and want to change your exam province, do so during this same remedy period. It is the only opportunity.
- If you are an applicant for M3 or M2, confirm the date, time and place of the first and second exercise in Madrid and prepare the mandatory material: black or blue ink pen and valid identification document.
- After the publication of the final list, if you are not satisfied with your situation, consider filing a claim with the Social Courts of Madrid within the allowed period.
Frequently asked questions
How much time do I have to remedy my exclusion in the Defense 2026 oppositions?
You have 10 business days counted from the publication of the resolution in the BOE, which took place on October 3, 2026. After that period without remedy, the exclusion will be final and you can only appeal to the Social Courts of Madrid once the final list is published.
How is exclusion remedied in the Defense Ministry labor personnel oppositions?
The remedy must be made exclusively through the IPS service of the General Access Point (PAG) of the General Administration of the State. No other channels are accepted. You must access with your identification, locate your file and provide the documentation or correction that eliminates the reason for exclusion.
Can I change the exam province in the Defense 2026 oppositions?
Yes, but only if you are an applicant for groups M1, E2 or E1, and only during the remedy period (10 business days from October 3, 2026). Applicants for M3 and M2 take their exercises in Madrid with no possibility of choosing a province.
Where are the exams for groups M3 and M2 held in the Defense 2026 oppositions?
Groups M3 and M2 will take first and second exercise in Madrid, on the date, time and place published in Resolution 430/38403/2026. Applicants must bring a black or blue ink pen and a valid identification document.
What happens if I disagree with the final list of admitted and excluded in Defense 2026?
After the publication of the final list, a period will open to file a claim with the Social Courts of Madrid. This is the challenge route provided by the regulation for those who are not satisfied with their situation in the selection process.
