The Department of Justice and Human Rights of the Basque Country assigns through this order the destinations in judicial offices of the three Basque historical territories to the civil servants who passed the open access selection process called in 2022. This is the final step of the admission process to the Judicial Support Corps.

Economic and operational impact

For the approved candidates, the impact is immediate and positive: the assignment of destination means the start of accrual of remuneration as a career civil servant of the Judicial Support Corps, with all the rights associated with that status.

For displaced interim civil servants, the impact is automatic cessation without the need for additional notice. The exact date of cessation depends on the specific day each permanent holder takes office, within the 20 working day period from September 1, 2026.

For those who already belong to the Procedural Management Corps or the Procedural Processing Corps, the regulation opens a relevant decision window: they can remain in their current corps and be placed on voluntary leave in the Judicial Support Corps, which means not losing their position on the seniority list of the corps of origin.

The 2-year restriction for transfer competitions is an operational constraint to keep in mind: new civil servants must remain in the assigned destination at least until July 2028, without the possibility of requesting a change of position through this channel.

Who does it affect?

• Candidates approved in the selection process of Order JUS/1288/2022 who access the Judicial Support Corps through the general open access system in the Basque Country.
• Interim civil servants who currently occupy the assigned positions in judicial offices in Álava, Gipuzkoa and Bizkaia: they cease automatically on the day the permanent holder takes office.
• Career civil servants of the Procedural Management Corps or the Procedural Processing Corps who have also passed this selection process and must decide whether to choose to continue in their current corps or join the Judicial Support Corps.
• Human resources managers of judicial bodies in the three Basque territories, who must manage the incorporation of new permanent holders and the cessation of interim staff.

Practical example

A candidate who passed the selection process of Order JUS/1288/2022 receives a destination in a judicial office in Bilbao (Bizkaia). The deadline for taking office begins on September 1, 2026 and has 20 working days, which places the approximate deadline around September 29, 2026 (excluding weekends and holidays).

In that same office, an interim civil servant who was covering the position ceases automatically on the day the permanent holder signs the taking of office, without any additional procedure being necessary on the part of the interim or the judicial body.

If that same candidate previously belonged to the Procedural Processing Corps, they have the option to communicate that they wish to continue in that corps. In that case, they would move to voluntary leave status in the Judicial Support Corps, retaining their position on the Procedural Processing seniority list.

Regardless of the option chosen, the new civil servant will not be able to request a transfer until July 2028.

What should those affected do now?

1. Confirm the assigned destination by consulting the resolution published in the BOE of July 21, 2026 and identifying the judicial office assigned in Álava, Gipuzkoa or Bizkaia.
2. Calculate the deadline for taking office: count 20 working days from September 1, 2026, excluding weekends and holidays of the corresponding territory.
3. Decide on the corps option (only if you belong to Procedural Management or Procedural Processing): formally communicate whether you choose to continue in the corps of origin and be placed on voluntary leave in Judicial Support, or if you join the new corps.
4. Manage the cessation of interim staff (HR managers of judicial bodies): prepare the cessation documentation for the exact day the permanent holder takes office, without the need for additional procedure.
5. Note the transfer restriction: block on the calendar the date of July 2028 as the first time you can participate in transfer competitions.
