The Resolution of July 8, 2026, issued by the General Directorate of Human Resources and Relations with the Administration of Justice of the Ministry of Presidency, sets September 1, 2026 as the reference date for the start of the office-taking deadline. From then on, each new official has 20 business days to take up their position.

The assignment is granted with mandatory character: it is not negotiable at this time and the official is bound to that position for at least two years before being able to apply for a transfer.

What does this regulation establish?

The resolution regulates the assignment of positions in judicial offices of the Madrid Community to officials of the Judicial Assistance Corps of the Administration of Justice who passed the free-entry selection process called by the Order JUS/1288/2022, of December 22. The key points are:

This requires these professionals to be alert to the date of the permanent official's office-taking to manage their employment situation in advance.

Officials from Case Management or Case Processing who also passed Judicial Assistance must economically evaluate whether the change of corps is worthwhile or if it is better to remain in their original corps on voluntary leave, as remuneration levels and career prospects may differ between corps.

Practical example

Imagine a candidate who passed the selection process of the JUS/1288/2022 call and receives mandatory assignment to a court of first instance in Madrid capital. The reference date is September 1, 2026, so they have until approximately September 29, 2026 (20 business days, excluding holidays) to present themselves and take office.

In that same court, an interim official currently works covering that position. On the exact day the permanent official signs their office-taking, the interim official is automatically ceased, without any additional procedure required from the interim official.

If that same candidate previously belonged to the Case Processing Corps, they have the option to not join Judicial Assistance and remain in their original corps, entering a situation of voluntary leave in Judicial Assistance. This decision has remuneration and career implications that should be analyzed before the office-taking deadline.

Furthermore, once taking office in Judicial Assistance, this official will not be able to request a transfer for 2 years, which means that if the assigned position is geographically inconvenient, they must accept that situation until at least September 2028.

What should affected parties do now?

1. Locate the resolution and verify the assigned position: consult the Resolution published in the BOE on July 21, 2026 to confirm the position and assigned judicial office.
2. Calculate the exact office-taking deadline: count 20 business days from September 1, 2026, excluding national and Madrid Community holidays, to not exceed the limit.
3. Decide on the original corps (if applicable): Case Management or Case Processing officials must evaluate before the office-taking date whether it is more convenient to continue in their original corps on voluntary leave or join Judicial Assistance.
4. File an appeal if appropriate: if you believe the assigned position is incorrect or there is an error in the process, file an appeal to the Vice-Counselor of Justice within 1 month from publication (before August 21, 2026).
