The data your company deposits in the Commercial Register—including annual accounts—is now an official source of national statistics. The INE and the College of Registrars of Property, Commercial and Personal Property of Spain have formalized an agreement, published in the BOE on October 10, 2026 (reference BOE-A-2026-21160), effective from October 1, 2026.

The agreement does not impose new reporting obligations on companies. Its logic is the opposite: instead of requesting more information from citizens and companies, the INE reuses existing administrative sources to reduce information burdens. But it has implications worth knowing about.

What does this regulation establish?

The agreement regulates the periodic supply of registry information to the INE and access to registry services, with two major areas of action:

1. Statistics from the National Statistical Plan 2025-2028

3. Eurostat Reservation on Gross National Income 2020-2024

The agreement also responds to a reservation made by Eurostat regarding the treatment of non-resident operators for VAT purposes, within the framework of the Gross National Income (GNI) verification process for the period 2020-2024. Access to registry data allows the INE to improve the quality of macroeconomic estimates that Spain submits to European institutions.

Economic and operational impact

For most companies, the direct impact is zero in terms of cost or administrative burden. The agreement does not require any action by commercial companies or owners of mortgaged properties.

However, there are three relevant operational consequences worth considering:

What should companies do now?

  1. Verify that financial statements deposits are up to date: If Commercial Register data will feed official statistics, having accounts deposited correctly and on time is more important than ever. An incomplete or incorrect deposit can distort the statistical data associated with your company.
  2. Review pending registry registrations: Any statutory amendment, change of administrator, or registrable act pending in the Commercial Register should be regularized. The data that circulates is what is registered.
  3. Inform the tax department if there are operations with non-residents: Companies with non-resident partners, financiers, or counterparties that have carried out VAT-subject operations in Spain between 2020 and 2024 should be aware that those operations are within the scope of the GNI verification that Eurostat is reviewing.
