Officials of the Case Management and Administrative Body of the Administration of Justice in Andalusia who passed the selection process called by the Resolution of August 5, 2026 already have their position assigned. The General Secretariat of Justice of the Ministry of Tourism, Justice, Deregulation and Local Administration of Andalusia has published the assigned positions following the entry process by internal promotion and competitive examination called by Order PJC/104/2024, of January 31.

The clock starts ticking on September 1, 2026: from that date, newly appointed officials have 20 business days to present themselves and take office in their new position. Failure to do so within the deadline has direct consequences on the official's administrative status.

What does this regulation establish?

The resolution regulates the administrative effects derived from the assignment of positions to personnel who passed the selection process of Order PJC/104/2024. The key points are as follows:

Regulated aspectSpecific detail
Start of office-taking calculationSeptember 1, 2026
Deadline for taking office20 business days from September 1, 2026
Mobility restrictionProhibition on participating in transfer competitions for 2 years from the resolution
Officials of Case Processing or Judicial AssistanceThose belonging to those bodies and choosing to continue in them must communicate this expressly to remain in voluntary leave status
Interim officials in assigned positionsThey automatically cease on the day the permanent official takes office
Unassigned positionsRemain vacant and may be announced in future ordinary competitions

The selection process combines two access routes: open entry by competitive examination and internal promotion, which means that among those assigned there are both newly hired officials and officials who already belonged to lower bodies (Case Processing and Judicial Assistance) and have been promoted.

Economic and operational impact

Although this resolution does not imply a direct economic cost for private companies, it has a relevant operational impact on the Administration of Justice in Andalusia and on the officials affected:

  • For newly appointed officials: taking office activates the right to receive compensation corresponding to the Case Management and Administrative Body, which represents a promotion in level and compensation compared to the Case Processing and Judicial Assistance bodies.
  • For interim officials: cessation is automatic and immediate at the moment the permanent official takes office, which implies the loss of compensation associated with the position held on an interim basis.
  • For the Administration: positions that remain vacant (unassigned) do not generate immediate personnel costs, but will need to be included in future ordinary competitions, extending the coverage process.
  • Mobility freeze for 2 years: assigned officials will not be able to request transfer until that period has elapsed, which affects the personal and family planning of those affected.

Who does it affect?

  • Officials who passed the selection process called by Order PJC/104/2024 and entered the Case Management and Administrative Body in Andalusia: must take office within the deadline.
  • Officials of the Case Processing and Judicial Assistance Body who accessed through internal promotion: must decide whether to continue in their original body (communicating this to remain in voluntary leave status) or take up the assigned position.
  • Interim officials currently occupying positions assigned to permanent officials: their service relationship ends on the day the permanent official takes office.
  • Judicial bodies and administrative units of the Administration of Justice in Andalusia that will receive the new permanent officials or manage the cessation of interim officials.
  • HR managers of the Ministry of Tourism, Justice, Deregulation and Local Administration of Andalusia, who must manage the procedures for taking office, voluntary leave and cessations.

Practical example

Let's imagine the case of an official of the Case Processing Body currently active in Seville who passed the selection process through internal promotion and has been assigned to a position in the Case Management and Administrative Body in Málaga.

This official has two options:

  1. Take up the new position in Málaga within 20 business days from September 1, 2026. By doing so, their position in Case Processing in Seville becomes vacant. They will not be able to request a transfer back to Seville for the next 2 years from the resolution.
  2. Communicate that they wish to continue in the Case Processing Body, in which case they will be placed in voluntary leave status in the Case Management and Administrative Body. They must communicate this expressly; if they do not, it is understood that they accept the assigned position.

Meanwhile, the interim official occupying the position in Málaga will automatically cease on the day the permanent official takes office, without requiring any additional procedure.

What should those affected do now?

  1. Verify the assigned position in the resolution published in the BOE on August 10, 2026 and confirm the position, location and assigned judicial body.
  2. Calculate the deadline for taking office: count 20 business days from September 1, 2026 to avoid non-compliance.
  3. Decide whether to remain in the original body (Case Processing or Judicial Assistance): those who choose to continue in those bodies must formally communicate this before taking office to remain in voluntary leave status in the Case Management Body.
  4. Manage personal and logistical transfer if the position involves a change of location, bearing in mind that there will be no possibility of transfer competition for 2 years.
  5. Interim officials affected must prepare for cessation and manage their employment situation, as the end of interim status is automatic and immediate on the day the permanent official takes office.
  6. HR managers of the Ministry must process the office-taking files, voluntary leave and cessations of interim officials within the established deadlines.

Frequently asked questions

When is the deadline to take office in the assigned position?

The deadline is 20 business days counted from September 1, 2026, the date the resolution enters into force. Newly appointed officials must present themselves at their assigned position before this deadline expires.

What if I am a Case Processing official and don't want to go to the new position?

Officials belonging to the Case Processing or Judicial Assistance Body who prefer to continue in those bodies must communicate this expressly. By doing so, they will be placed in voluntary leave status in the Case Management and Administrative Body. If they do not communicate anything, it is understood that they accept the assigned position.

When does the interim official occupying a position assigned to a permanent official cease?

The interim official's cessation is automatic on the same day the permanent official takes office. It does not require any additional procedure on the part of the interim official.

Can I request a transfer to another location after taking office?

Not during the first 2 years from the resolution. Assigned officials are prohibited from participating in transfer competitions during that period. After that period has elapsed, they may compete normally.

What happens to positions that have not been assigned?

Unassigned positions remain vacant. They are not filled immediately, but may be announced in future ordinary transfer competitions.
