Section 9th of the Provincial Court of Málaga will assume from January 1, 2027 exclusive and non-exclusive jurisdiction over violence against children and adolescents. The agreement, adopted by the Permanent Commission of the General Council of the Judicial Power on July 14, 2026 and published in the BOE on July 29, 2026, implements the provisions of articles 80.3, 82 and 82 bis 2 of the Organic Law 6/1985, of July 1, on the Judicial Power.

The measure follows the same logic as the specialization already consolidated in matters of gender violence: concentrating in judges with specific training and sensitivity the cases that require differentiated technical and human treatment. The deadline until January 1, 2027 allows for internal reorganization of the court.

What does this regulation establish?

The agreement grants Section 9th of the Provincial Court of Málaga exclusive and non-exclusive specialization in violence against children and adolescents. It is important to understand what each term means:

  • Exclusive: only Section 9th will hear new cases of this matter filed from January 1, 2027 in the province of Málaga.
  • Non-exclusive: cases already in proceedings in other bodies of the Provincial Court at the time of entry into force are not reassigned; they continue until their final resolution in the body to which they are assigned.

The legal basis is articles 80.3, 82 and 82 bis 2 of the Organic Law on the Judicial Power, which empower the General Council of the Judicial Power to assign specific sections of provincial courts specialization in certain matters.

This formula is already applied in Spain in areas such as gender violence, prison surveillance or commercial jurisdiction, and is now extended to the protection of minor victims of violence, recognizing the technical specificity and sensitivity that these proceedings require.

Operational and institutional impact

This regulation does not generate fees, sanctions or direct costs for private companies. Its impact is operational and institutional, and translates into concrete changes for legal operators and child protection services in Málaga:

  • Concentration of jurisdiction: all new appeals and proceedings for violence against minors will be directed to Section 9th, which requires knowing the new assignment to submit documents and appeals correctly.
  • Specialized judges: the resolution of these cases will fall to judges with specific training, which is expected to improve the consistency and quality of rulings.
  • Internal reorganization of the court: the Provincial Court of Málaga has the entire second half of 2026 to adapt its distribution of cases and human resources.
  • No retroactivity: proceedings in progress are not affected by the change in jurisdiction.

Who does it affect?

  • Minor victims of violence in the province of Málaga and their families: their cases will be heard by specialized judges from January 1, 2027.
  • Lawyers and court officers practicing in the Provincial Court of Málaga: they must direct new documents and appeals in this matter to Section 9th.
  • Provincial Public Prosecutor's Office of Málaga: will adapt its internal organization to coordinate with the specialized section.
  • Social services and child protection entities in Málaga: regular interlocutors in these proceedings, who must know the new competent body.
  • Other bodies of the Provincial Court of Málaga: will cease to assume new cases of this matter, although they will maintain those already filed until their resolution.

Practical example

A lawyer in Málaga representing a family in proceedings for violence against a minor must distinguish between two scenarios:

  • Proceedings filed before January 1, 2027: the case continues in the body of the Provincial Court to which it is currently assigned. There is no change in jurisdiction or need to redirect documents.
  • Proceedings filed from January 1, 2027: the case falls exclusively to Section 9th of the Provincial Court of Málaga. Any appeal, document or proceeding must be directed to this section. Submitting it to another section could generate procedural issues.

This same criterion applies to the Public Prosecutor's Office, social services and any party appearing in the proceedings.

What should legal operators do now?

  1. Identify proceedings in progress: review whether there are cases of violence against minors in proceedings before the Provincial Court of Málaga to confirm that they will continue in the current body until their final resolution.
  2. Update internal protocols: law firms, public prosecutor's office and social services must record that, from January 1, 2027, Section 9th is the competent body for new cases.
  3. Verify court reorganization: stay alert to internal communications from the Provincial Court of Málaga regarding the distribution of cases and judges assigned to Section 9th.
  4. Train the team: professionals involved in these proceedings must be aware of the procedural particularities of the new specialized section before entry into force.
  5. Consult the official source: review the full text of the agreement published in the BOE on July 29, 2026 to confirm the exact scope of the specialization.

Frequently asked questions

When does the specialization of Section 9th of the AP Málaga in violence against minors come into force?

The specialization takes effect from January 1, 2027. The agreement was adopted on July 14, 2026 and published in the BOE on July 29, 2026, leaving a period of approximately five months for the internal reorganization of the court.

What happens to proceedings for violence against minors that are already in progress in the AP Málaga?

Cases already filed before January 1, 2027 are not reassigned to Section 9th. They will continue to be processed by the bodies to which they are assigned until their final resolution. Only new proceedings initiated from that date will fall exclusively to Section 9th.

What does it mean that the specialization is "exclusive and non-exclusive"?

"Exclusive" means that only Section 9th will hear new cases of violence against minors in Málaga from January 1, 2027. "Non-exclusive" means that proceedings already in progress in other bodies of the Provincial Court are not transferred to Section 9th, but remain where they are until their resolution.

What legal basis supports this specialization?

The agreement is based on articles 80.3, 82 and 82 bis 2 of Organic Law 6/1985, of July 1, on the Judicial Power, which empower the General Council of the Judicial Power to assign specializations to specific sections of provincial courts.

Does this regulation affect other provinces or only Málaga?

The agreement affects exclusively the province of Málaga and Section 9th of its Provincial Court. It has no effect on other provincial courts or other territories. It is a specific measure for Málaga, although it follows the general trend of judicial specialization already applied in other matters and jurisdictions.
