If your company regularly delegates procedures before ministries, autonomous bodies or any entity of the General Administration of the State, this change saves you time and money from now on. The Resolution of October 12, 2026 from the State Secretariat for Civil Service updates the model of annex IV of Order PCM/1384/2021 and eliminates two of the biggest bottlenecks in the process: the requirement for notarial power and individualized legal review by the legal service.
The change is operative immediately: it entered into force on October 22, 2026, one day after its publication in the BOE.
What does this regulation establish?
The Electronic Register of Powers of the General Administration of the State (REA-AGE) is the system that allows natural and legal persons to authorize a representative to act before the AGE on their behalf. Until now, the registration process involved costly and slow steps.
The resolution updates the model of annex IV of Order PCM/1384/2021 and introduces the following procedural change:
| Aspect | Before (until 21/10/2026) | Now (from 22/10/2026) |
|---|---|---|
| Registration document | Mandatory notarial power | Standardized electronic form as a private document |
| Who initiates the process | More rigid procedure, without clear initiation by the authorized representative | The authorized person initiates the registration |
| Principal's signature | Signature before notary | Electronic signature of the principal on the form |
| Legal review | Mandatory by the competent legal service | Eliminated: no individualized legal review required |
| Registration timelines | Longer due to notarial and legal review procedures | Significantly reduced |
| Where it is managed | Apodera / PAG | Apodera / General Access Point (no platform changes) |
It is important to emphasize what does not change: the circumstances under which a power can be granted and the registration requirements remain unchanged. The resolution only streamlines the procedure, it does not expand or restrict who can be authorized or for what acts.
Economic and operational impact
The savings are twofold: in direct cost and in management time.
- Notarial cost eliminated: A notarial power deed for administrative procedures can cost between 100 and 300 euros per act, depending on the notary and complexity. With the new electronic form, that cost disappears.
- Elimination of legal review: Legal review—the legal review that verified the validity of the power—generated delays of days or weeks depending on the legal service's workload. By eliminating it, registration can be completed in the same act.
- Reduction of administrative burden: Companies with recurring management before the AGE (tenders, subsidies, appeals, communications) that renew or expand powers periodically will notice the impact immediately.
- No adaptation cost: The updated form is already available in the Apodera application and in the General Access Point. There is no need to install anything new or hire additional services.
Who does it affect?
- Companies that bid or contract with the AGE: They need accredited representatives to submit offers, sign contracts or manage incidents.
- SMEs and self-employed with procedures before ministries or autonomous bodies: Subsidies, aid, administrative appeals, communications.
- Tax, labor advisors and management firms: That act on behalf of their clients before the AGE and need powers registered in the REA-AGE.
- Legal and compliance departments: That manage corporate representation before public bodies.
- Civil servants and public employees: That process powers on behalf of public sector entities.
- Private citizens: That delegate to a family member or professional to manage procedures with the AGE.
Practical example
A logistics SME needs its management firm to act on its behalf before the Tax Agency (integrated into the AGE) to submit appeals and manage electronic notifications.
Before October 22, 2026: The company had to go to the notary, grant a power deed in favor of the management firm, pay notarial fees and wait for the competent legal service to perform the legal review. The process could take between one and three weeks and cost 150-250 euros just in notarial fees.
From October 22, 2026: The management firm (authorized representative) accesses the Apodera application or the General Access Point, completes the standardized electronic form of the new annex IV, and sends it to the legal representative of the SME (principal). They sign it electronically. The registration is completed without a notary, without legal review and on the same day. Additional cost: zero euros.
What should companies do now?
- Review the powers currently registered in the REA-AGE: Check if you have active powers that were granted via notary. It is not necessary to renew them, but if you need to modify or expand them, you can now do so with the new electronic form.
- Inform your management firm or advisory: If you delegate procedures before the AGE to a third party, let them know that the process of registering new powers is now faster and without notarial cost.
- Access the Apodera application or the General Access Point: The updated form of annex IV is already available on both platforms from October 22, 2026.
- Use the new form for any new power of attorney: From now on, to register a new power before the AGE, the authorized representative initiates the process with the electronic form and the principal signs it digitally. No more steps.
- Update internal procedures: If your company has a power management protocol that included notarial or legal review steps, update it to reflect the new simplified workflow.
Frequently asked questions
Do you no longer need to go to the notary to register a power in the REA-AGE?
Correct. As of October 22, 2026, registration in the Electronic Register of Powers of the AGE can be done through a standardized electronic form as a private document. The principal signs it electronically, without the need for a notarial deed.
What is legal review and why is it eliminated?
Legal review was the review carried out by the competent legal service to verify that the power granted was valid and sufficient for the act in question. With the new standardized form, this individualized procedure disappears, which significantly reduces registration timelines.
Where is the new power of attorney form processed?
The updated form of annex IV is available in the Apodera application and in the General Access Point (PAG) of the General Administration of the State. No additional installation is required.
Do the circumstances or requirements for registering a power change?
No. The resolution only updates the registration procedure (the annex IV form). The circumstances under which a power can be granted and the registration requirements remain exactly the same as before.
When did this change enter into force?
October 22, 2026, one day after its publication in the BOE (October 21, 2026). The change is immediately applicable.
