Manufacturers, importers and distributors of tobacco in Spain have a new operational obligation from the same day of its publication: to affix the new tax stamp models to their packages. The Order HAC/1080/2026 modifies Order HAC/66/2024 and updates the models with state-of-the-art security technologies produced by the FNMT. There is no announced transition period: the regulation enters into force on the same day of its publication.

The change is not cosmetic. It responds to a European traceability obligation that, since May 2024, applies to all tobacco products, expanding the scope that previously was limited to cigarettes and rolling tobacco. And it opens the door to a future extension of the Special Tax to new product categories.

What does this regulation establish?

Order HAC/1080/2026 introduces the following changes to Order HAC/66/2024:

AspectBefore (HAC/66/2024)Now (HAC/1080/2026)
Tax stamp modelsModels approved in January 2024New models with improved security technologies (FNMT)
Scope of covered productsMainly cigarettes and rolling tobaccoAll tobacco products (extension since May 2024)
Anticipation of new categoriesNot contemplatedDesign prepared for possible extension to liquids for electronic cigarettes and nicotine pouches
Substantive legal regimeNo changesNo changes (the objective scope of the tax is not modified)
Inspection powersCommissioner for the Tobacco MarketNo changes: maintains inspection and authenticity verification powers

It is essential to understand that the regulation does not modify the substantive legal regime of the Special Tax on Tobacco Products nor formally expands its objective scope. The possible extension to liquids for electronic cigarettes and nicotine pouches would require additional regulatory transposition. What it does do is prepare the tax stamps for that scenario.

Economic and operational impact

The direct impact of this regulation is operational, not fiscal in terms of new rates or tax types. The costs for affected companies derive from:

  • Replacement of tax stamps: Packages must incorporate the new models with improved security technologies. This involves coordinating with the FNMT the supply of new stamps and adapting production or labeling lines.
  • Management of existing stock: The immediate entry into force (October 13, 2026) requires reviewing the inventory of old tax stamps and determining their status.
  • Adaptation to new categories: Although the extension to liquids for electronic cigarettes and nicotine pouches is not yet mandatory, companies operating in these segments must monitor the additional regulatory transposition that could activate that obligation.
  • Enhanced inspection: The Commissioner for the Tobacco Market maintains its inspection and authenticity verification powers, which means that old or non-compliant stamps may be subject to control.

No specific amounts for fees or unit costs of the new stamps have been published in the text of the regulation. The actual cost will depend on the production or import volume of each operator and the supply conditions agreed with the FNMT.

Who does it affect?

  • Manufacturers of tobacco products with production destined for the Spanish market: must incorporate the new models in their production lines.
  • Importers of tobacco products in Spain: obligated to affix the new stamps before putting products into circulation.
  • Distributors managing products pending commercialization: must verify the compliance of tax stamps on their stock.
  • Operators of electronic cigarettes and nicotine pouches: not affected today by the Special Tax, but must monitor the additional regulatory transposition that could extend the obligation to their products.

Practical example

A Spanish importer bringing cigarette packs from a third country has in its warehouse a batch pending distribution with tax stamps from the previous model (approved by Order HAC/66/2024). From October 13, 2026, new packages entering Spain must bear the updated models with FNMT security technology.

This importer must:

  1. Contact the FNMT to request the new tax stamp models.
  2. Review whether the stock already marked with the previous model can continue to circulate or requires relabeling (aspect to be confirmed with the Commissioner for the Tobacco Market).
  3. Update its reception and labeling processes to ensure that all new batches incorporate the model in force from October 2026.

The same scenario applies to a national manufacturer of cigars or pipe tobacco: products that previously could remain in a traceability limbo are now expressly included in the reinforced tax stamp system.

What should companies do now?

  1. Contact the FNMT immediately to learn about the process for requesting and supplying the new tax stamp models with improved security technologies.
  2. Audit current tax stamp stock and determine which batches already marked with the previous model can continue in circulation and which require updating.
  3. Update operational processes for production, importation and distribution to ensure that all new packages incorporate the model in force from October 13, 2026.
  4. Coordinate with the Commissioner for the Tobacco Market any questions about the verification of authenticity of stamps and the applicable inspection regime.
  5. If you operate in electronic cigarettes or nicotine pouches, actively monitor the additional regulatory transposition that could extend the Special Tax and marking obligations to your products.

Frequently asked questions

What regulation does Order HAC/1080/2026 modify and what exactly changes?

Order HAC/1080/2026 modifies Order HAC/66/2024, of January 25, which approved the development rules for tobacco tax stamps. The specific change consists of the approval of new tax stamp models with improved security technologies, manufactured by the FNMT, in response to the European traceability obligation extended since May 2024 to all tobacco products.

When is it mandatory to use the new tobacco tax stamp models?

From October 13, 2026, the date of publication and entry into force of Order HAC/1080/2026. There is no transition period announced in the regulation: the obligation is immediate.

Does this regulation affect electronic cigarettes and nicotine pouches?

Directly, no: Order HAC/1080/2026 does not modify the objective scope of the Special Tax on Tobacco Products. However, the new tax stamp models have been designed anticipating a possible future extension of the tax to liquids for electronic cigarettes and nicotine pouches. That extension would require additional regulatory transposition that has not yet occurred.

Who manufactures the new tobacco tax stamps and how are they obtained?

The new tax stamps are manufactured by the National Factory of Mint and Stamp (FNMT). Manufacturers, importers and distributors must contact the FNMT to request the supply of the new models. The Commissioner for the Tobacco Market maintains its inspection and authenticity verification powers for the stamps.

What happens if a distributor has stock with old tax stamps?

The regulation does not specify a transition regime for stock already marked with the previous model. It is essential to consult with the Commissioner for the Tobacco Market to determine whether that stock can continue in circulation or must be subject to relabeling, given that the Commissioner maintains its inspection and authenticity verification powers.
