What does this regulation establish?

Order PJC/884/2026 assigns specific positions in courts and prosecutor's offices throughout Spain to officials of the Judicial Assistance Body who passed the extraordinary selection process called in 2022. The most relevant aspects are:

• Assigned positions: each approved candidate receives a specific position in a specific judicial body or prosecutor's office at any point in the national territory.
• Deadline for taking office: 20 working days counted from September 1, 2026. Exceeding this deadline without justification may compromise incorporation.
• Option for officials from other bodies: those who already belong to the Procedural Management Body or the Procedural Processing Body of the Administration of Justice must formally choose between continuing in their current body or joining the Judicial Assistance Body. They may also request voluntary leave of absence.
• Cessation of interim officials: interim officials who currently occupy the assigned positions will cease automatically on the day the permanent official takes office, without requiring any additional procedure.
• Mobility restriction: new officials will not be able to participate in transfer competitions for the first two years from the date of publication of the order (that is, until August 24, 2028, at minimum).

Economic and operational impact

For those approved, the most immediate impact is the need to organize their physical incorporation to the assigned position within a very tight deadline: 20 working days from September 1, 2026. This implies possible relocation expenses, housing search, and management of deregistration in the municipality of origin if the position is in another province.

For those who already belong to another body of the Administration of Justice, the decision to choose between bodies has direct consequences on their professional career, compensation, and future mobility options. For the receiving judicial bodies and prosecutor's offices, the arrival of new permanent officials means the immediate departure of interim officials who were covering those positions, which may generate a transitional period of operational adaptation.

The two-year restriction on participating in transfer competitions limits the mobility of new officials until at least August 24, 2028, which must be taken into account in personal and professional planning.

Who does it affect?

• Those approved in the extraordinary selection process for Judicial Assistance called by Order JUS/1327/2022, of December 28, who have not yet taken office in their position.
• Officials of the Procedural Management and Procedural Processing Bodies of the Administration of Justice who also passed this selection process and must choose between bodies.
• Interim officials who currently occupy the positions assigned to new permanent officials: they will cease automatically at the moment of taking office.
• Judicial bodies and prosecutor's offices throughout Spain that receive the new permanent officials and must manage the transition from interim coverage.

Practical example

An approved candidate in the 2022 selection process who currently works as an interim official in a Madrid court receives, with this order, a permanent position in a prosecutor's office in Seville. From September 1, 2026, they have 20 working days to present themselves and take office in Seville.

If they also previously belonged to the Procedural Processing Body, they must formally communicate their choice: join the Judicial Assistance Body (with the position in Seville) or continue in Procedural Processing (renouncing the assigned position). They may also request voluntary leave of absence in Procedural Processing while joining Judicial Assistance, which gives them time to evaluate the decision without permanently losing their previous position.

The interim official who until then was covering the position in the Seville prosecutor's office ceases automatically on the day the new permanent official takes office, without requiring any additional procedure on their part.

From the date of the order (August 24, 2026), the new official will not be able to request a transfer to another position until August 24, 2028 at minimum.

What should those affected do now?

1. Locate the assigned position in the text of Order PJC/884/2026 published in the BOE on August 24, 2026 and confirm the judicial body or prosecutor's office of destination.
2. Calculate the exact deadline for taking office: 20 working days from September 1, 2026. Deduct national and regional holidays of the destination location to avoid incurring in delay.
3. If you belong to another body of the Administration of Justice (Procedural Management or Processing): urgently decide whether to choose Judicial Assistance, remain in your current body, or request voluntary leave of absence. This decision has long-term compensation and career consequences.
4. Manage personal relocation procedures if the position involves a change of province: accommodation, registration, possible assistance for forced relocation provided for in the applicable collective agreement or regulation.
5. Note the mobility restriction: you will not be able to participate in transfer competitions until August 24, 2028 at minimum. Plan your professional career taking into account this mandatory permanence period.
6. If you are an interim official in an assigned position: prepare for automatic cessation on the date the permanent official takes office, without requiring any additional procedure but with the labor provision that this implies.
