If you are a recipient of an INSS family benefit and reside in Gipuzkoa, Social Security has automatic access to your tax data. This is not new, but it has just been extended for four more years, until 2030, and with a broader scope than before.

The Resolution of October 5, 2026 publishes the addendum that extends and modifies the agreement between the National Institute of Social Security (INSS) and the Gipuzkoa Provincial Council. The objective is to verify that those receiving benefits subject to income limits truly meet the required economic requirements.

2030
Year until which the agreement is extended
4 types
of income transferred: work, capital, economic activities and capital gains
Without consent
Data transfer does not require authorization from the interested party

What does this regulation establish?

The original agreement between the INSS and the Gipuzkoa Tax Authority allowed automated exchange of tax information to verify that family benefit recipients did not exceed the established income limits. The addendum published in October 2026 introduces three main changes:

AspectPrevious situationSituation after the addendum
Agreement validityExpiration prior to 2026Extended until 2030
Scope of data exchangeOnly maintenance of the rightInitial recognition + maintenance of the right
Database accessPrevious technical annexesNew access to updated provincial databases (DADs)
Exchange channelEditran files (electronic)Editran files (electronic, no changes)
Further transfers to third partiesNot provided forNot provided for

The legal basis that supports the transfer of data without the consent of the interested party is the General Social Security Law. The data that the Provincial Council transfers to the INSS are:

  • Work income
  • Capital income
  • Income from economic activities
  • Capital gains

The exchange is carried out electronically through Editran files. The data received by the INSS is not transferred to third parties in any case.

Economic and operational impact

For family benefit recipients in Gipuzkoa, the main impact is the greater capacity for detection by the INSS of situations where actual income exceeds the limits that entitle the recipient to the benefit.

Until now, data exchange was only applied to maintenance of the right, that is, to those who were already receiving the benefit. With the addendum, the INSS will also be able to consult provincial tax data at the time of initial recognition, before granting the aid. This implies:

  • Greater rigor in the application phase: declared data will be automatically verified against the Tax Authority.
  • Less room for discrepancies between income declared for benefit purposes and actual income registered in Gipuzkoa.
  • Possibility for the INSS to detect incompatibilities before granting the benefit, not only after.

For the administration, the system represents a reduction in fraud in benefits subject to income limits without the need to request additional documentation from the applicant.

Who does it affect?

  • Current INSS family benefit recipients residing in Gipuzkoa: their provincial tax data will continue to be consulted periodically to verify that they maintain the right.
  • New applicants for family benefits residing in Gipuzkoa: data exchange will be applied already in the initial recognition phase, before the benefit is granted.
  • Advisors and managers who process family benefits for clients in Gipuzkoa: must be aware that the INSS has automated access to their clients' provincial tax data.
  • Employers and HR departments with workers in Gipuzkoa who receive family benefits: indirectly affected if there are discrepancies in declared work income.

Practical example

A person residing in Donostia applies to the INSS for a family benefit subject to an income limit. They declare annual income that, in principle, entitles them to the aid.

With the extended and expanded agreement, the INSS can automatically consult the Gipuzkoa Tax Authority for that person's data: work income, capital returns, income from economic activities and capital gains registered in the provincial databases (DADs). If the provincial data reflects income higher than that declared in the application, the INSS can deny initial recognition without needing to request additional documentation from the interested party.

Before this addendum, that same exchange only occurred once the benefit was granted, during the maintenance phase. Now it also acts as a prior filter.

What should beneficiaries do now?

  1. Review the consistency of declared income: If you are a beneficiary or are going to apply for a family benefit in Gipuzkoa, make sure that the income you declare to the INSS matches that registered with the Tax Authority (work income, capital, economic activities and capital gains).
  2. Inform your clients if you are an advisor: Managers who process family benefits for Gipuzkoa residents should warn their clients that the INSS has automated access to their provincial tax data, both when applying and during receipt.
  3. Update data in case of income change: If the beneficiary's income varies during the validity of the benefit, notify the INSS before the automatic exchange detects the discrepancy.
  4. Do not assume the system only acts when renewing: With the expanded scope, data exchange operates from the initial application, not only in periodic maintenance.

Frequently asked questions

What tax data can the INSS consult about Gipuzkoa beneficiaries?

The INSS can access four types of income transferred by the Gipuzkoa Tax Authority: work income, capital income, income from economic activities and capital gains. The exchange is carried out automatically through Editran files and without requiring the consent of the interested party, under the General Social Security Law.

Until when is the agreement between the INSS and the Gipuzkoa Provincial Council valid?

The agreement has been extended through the addendum published on October 12, 2026 (in force since October 10, 2026) and extends until 2030, that is, four additional years from the previous expiration date.

Does the INSS need my authorization to consult my tax data with the Gipuzkoa Tax Authority?

No. The transfer of data from the Gipuzkoa Provincial Council to the INSS does not require the consent of the interested party. It is carried out under the General Social Security Law and has the sole purpose of verifying compliance with economic requirements to access or maintain family benefits.

What changes regarding the previous agreement in terms of the scope of data exchange?

The main change is that data exchange now also applies to initial recognition of the right, not only to maintenance. Previously, the INSS only consulted provincial tax data once the benefit was granted. With the addendum, it can do so already in the application phase, before granting the aid. Additionally, technical annexes are updated with new access to provincial databases (DADs).

Is the data received by the INSS shared with other administrations or third parties?

No. The regulation expressly establishes that no further transfers of data to third parties are provided for. The tax data transferred by the Gipuzkoa Tax Authority to the INSS is used exclusively to verify compliance with economic requirements for family benefits.
