What does this regulation establish?

Order EFD/686/2026 resolves, center by center, the requests to modify agreements submitted by private subsidized schools in Ceuta and Melilla. The resolutions are divided into two blocks:

Approved expansions

Only three centers obtain expansions of Therapeutic Pedagogy (PT) units:

The agreements approved in this resolution will have validity until the 2028-2029 academic year, providing stability to the benefited centers for three academic years.

Denied requests

The order denies numerous additional requests for:

• New Therapeutic Pedagogy (PT) units not included in previous approvals
• Speech and Language units
• Educational support at different levels

The reasons for denial are two: budget insufficiency and existence of already available coverage for the alleged needs.

Formalization procedure

Centers with approved modifications must formalize the changes through deed before the corresponding Provincial Directorates. The minimum deadline to do so is 48 hours from notification.

Economic and operational impact

For centers with approved expansions, the incorporation of new PT units means access to additional public funding linked to the agreement, with guaranteed validity until 2028-2029. This allows planning staff and resources for diversity care with a three-year horizon.

For centers with denied requests, the impact is the opposite: they must assume with their own resources the needs for PT, Speech and Language, or educational support that have not obtained public coverage. Denial due to "budget insufficiency" does not close the door to future requests, but it does require managing the current year without the expected reinforcement.

Operatively, denied centers have two options: assume the cost of support resources without subsidized funding, or file an administrative litigation claim before the National Court within two months from notification.

Practical example

The school La Inmaculada requested the expansion of its Therapeutic Pedagogy units to better serve students with specific educational support needs. Order EFD/686/2026 approves that specific expansion.

From the notification, the center has a minimum period of 48 hours to appear before the corresponding Provincial Directorate and formalize the change through deed. Once that procedure is completed, the new expanded agreement becomes effective from the 2026/2027 academic year and will remain active until the end of the 2028-2029 academic year, allowing the center to plan its PT resources with certainty for three years.

In contrast, a center that has requested a Speech and Language unit and has received denial due to budget insufficiency, must decide before two months from notification whether to file an administrative litigation claim before the National Court, or assume the year without that additional funding.

What should centers do now?

1. Verify the status of your request: Check if your center is among the approved ones (La Inmaculada, San Daniel, Nuestra Señora del Buen Consejo) or if your request has been denied.
2. If you have an approved expansion: Contact the Provincial Directorate of Education in Ceuta or Melilla and formalize the deed within a minimum of 48 hours from notification. Do not let this procedure pass or the change may become void.
3. If your request has been denied: Analyze the reasons (budget insufficiency or existing coverage) and assess with legal advice whether it is appropriate to file an administrative litigation claim before the National Court. The deadline is two months from notification.
4. Plan support resources for the 2026/2027 academic year: If the denial is final, adjust the allocation of PT, Speech and Language, or educational support using the center's own resources to not compromise student care.
5. Update your planning until 2028-2029: If you have an approved agreement, incorporate the validity until the 2028-2029 academic year in your budget and staff planning.
