Industrial companies recently created in areas affected by the DANA of October-November 2024 faced a specific problem: the Reinicia+ FAIIP DANA mechanism required them to demonstrate three years of prior activity, a requirement that completely blocked their access to financing. The modification approved by the Council of Ministers on October 6, 2026 and published in the BOE on October 23 eliminates that obstacle with effect from the following day.

The measure also corrects an asymmetry that existed from the beginning: the ordinary FAIIP never required minimum seniority. The DANA version, designed precisely to help companies in more vulnerable situations, imposed a more restrictive requirement than the standard instrument. That inconsistency is now resolved.

What does this regulation establish?

The resolution publishes the Agreement of the Council of Ministers of October 6, 2026, which modifies the original Agreement of January 21, 2025. The changes are two and are specific:

AspectBefore (Agreement 21/01/2025)After (modification 06/10/2026)
Minimum seniority3 years of prior activity mandatoryEliminated. No minimum seniority requirement
Eligible industrial activitiesCNAE divisions 10-32CNAE divisions 10-32 + circular economy + advanced services to industry + agri-food sector in industrial facilities

The remaining access conditions remain unchanged: the company must have tax domicile or industrial establishment in municipalities affected by DANA and must be favorably evaluated by SEPIDES before accessing financing.

Economic and operational impact

The elimination of the seniority requirement has a direct impact on two types of companies that were previously excluded:

  • Industrial startups established in the months following DANA, which were created precisely to fill productive gaps left by destroyed companies.
  • Companies undergoing restructuring that changed their activity or legal form after suffering DANA damage, and that technically did not accumulate three years in their current configuration.

The expansion of the CNAE scope also has relevant economic consequences. Activities that were previously in a gray area — such as recycling plants, industrial engineering service providers, or agri-food processing facilities — become explicitly eligible. This expands the universe of potential beneficiaries without the need for additional regulatory changes.

From an operational perspective, SEPIDES' favorable evaluation remains the access filter. Interested companies must prepare their file taking into account that this evaluation process has its own timelines and documentary requirements.

Who does it affect?

  • Newly created companies with tax domicile or industrial establishment in municipalities affected by the DANA of October-November 2024.
  • Industrial SMEs that did not meet the 3-year requirement and had ruled out applying for FAIIP DANA.
  • Companies undergoing restructuring after DANA damage, that changed their activity or legal structure.
  • Circular economy companies with facilities in affected areas (previously excluded for not fitting CNAE divisions 10-32).
  • Advanced service providers to industry located in DANA municipalities.
  • Agri-food sector companies operating in industrial facilities in affected areas.
  • Financial advisors and consultants managing financing files for clients in DANA areas.

Practical example

An industrial waste management company established in February 2025 — four months after DANA — with facilities in an affected municipality attempted to access Reinicia+ FAIIP DANA in the first half of 2026. Its application was rejected for not meeting the three-year prior activity requirement. Its activity, moreover, did not directly fit CNAE divisions 10-32 as it was circular economy.

With the modification in force from October 24, 2026, that same company can resubmit its application: the seniority requirement has disappeared and circular economy is now expressly included among eligible activities. The only prior step remains obtaining favorable evaluation from SEPIDES, which acts as a viability filter for the project.

What should companies do now?

  1. Verify if the municipality is included in the list of areas affected by the DANA of October-November 2024. The tax domicile or industrial establishment must be in one of those municipalities.
  2. Review if the activity is eligible by checking if it fits CNAE divisions 10-32 or one of the new incorporated categories: circular economy, advanced services to industry, or agri-food sector in industrial facilities.
  3. Prepare the file for SEPIDES: favorable evaluation from this body is a prior and essential requirement to access financing. Gather financial documentation, business plan, and justification of DANA impact.
  4. Submit the application without delay: the modification has been in force since October 24, 2026. Companies that had been rejected due to the seniority requirement can reapply.
  5. Consult with a specialized advisor if the activity is in a gray area regarding the new expanded CNAE categories, to correctly argue eligibility to SEPIDES.

Frequently asked questions

What companies can now access FAIIP DANA after the modification?

Any industrial company with tax domicile or industrial establishment in municipalities affected by the DANA of October-November 2024, regardless of its seniority. Previously, a minimum of 3 years of prior activity was required; that requirement has been eliminated by the Agreement of the Council of Ministers of October 6, 2026, in force from October 24, 2026.

What activities are eligible for Reinicia+ FAIIP DANA after the change?

CNAE divisions 10-32 (manufacturing industry), plus the new categories explicitly incorporated: circular economy activities, advanced services to industry, and agri-food sector in industrial facilities. Previously, only CNAE divisions 10-32 were contemplated.

What is SEPIDES and what role does it play in accessing FAIIP DANA?

SEPIDES is the evaluating body that must issue a favorable evaluation before a company can access financing from the Reinicia+ FAIIP DANA mechanism. This requirement remains unchanged after the modification. Without that positive evaluation, it is not possible to access the instrument.

Can companies rejected for lack of seniority reapply for FAIIP DANA?

Yes. Companies that were rejected for not meeting the 3-year prior activity requirement can submit a new application from October 24, 2026, the date the modification enters into force. The seniority requirement has been eliminated.

How does FAIIP DANA differ from ordinary FAIIP?

Ordinary FAIIP never required minimum seniority. The Reinicia+ FAIIP DANA mechanism, created for DANA-affected areas, did require it (3 years), creating an asymmetry that harmed the most vulnerable companies. The modification of October 6, 2026 corrects that inconsistency by aligning both instruments on this point.
