The Resolution of July 20, 2026 from the State Secretariat for Civil Service, published in the BOE on July 27, 2026, formalizes the appointments resulting from the selection process called in December 2024. The clock for the possession deadline is already running.

The resolution channels appointments through three different routes: open access, internal promotion and change of legal status for fixed-term labor personnel included in Annex II of the IV Single Agreement for labor personnel of the AGE. Each route has different remuneration and level conditions.

What does this regulation establish?

The resolution formalizes the appointment as career civil servants of candidates who passed the selection process called in December 2024. Appointments are made through three differentiated routes:

Before taking possession, all new civil servants must take an oath to the Constitution, in accordance with Royal Decree 707/1979. This procedure is prior and essential for the appointment to take full effect.

The resolution exhausts the administrative route. If any affected party disagrees with their appointment or assigned conditions, they may file:

• Motion for reconsideration: within 1 month from BOE publication.
• Administrative contentious appeal before the National Court: within 2 months from BOE publication.

Economic and operational impact

For new civil servants, the remuneration impact is immediate from the date of taking possession. The difference between the two access routes is significant in terms of specific allowance:

For the Administration, the resolution means the incorporation of new personnel into the Faculty Corps of Archivists, Librarians and Archaeologists, filling positions that were vacant since the December 2024 call. The budgetary impact depends on the total number of positions called, data that does not appear in the published resolution.

For fixed-term labor personnel accessing through change of legal status, the resolution means the transition from a labor regime (IV Single Agreement AGE) to a civil service regime, with the differences in rights, obligations and remuneration that this entails.

Who does it affect?

• Candidates approved by open access in the selection process of the Faculty Corps of Archivists, Librarians and Archaeologists called in December 2024.
• Civil servants from other AGE bodies who accessed through internal promotion to the Faculty Corps of Archivists, Librarians and Archaeologists.
• Fixed-term labor personnel of the AGE included in Annex II of the IV Single Agreement who opted for change of legal status towards civil service status.
• Human resources and payroll units of AGE organizations that must manage the taking of possession, constitutional oath and payroll entry of new civil servants.

Practical example

An opposition candidate who passed by open access and receives their appointment on July 27, 2026 has until August 11, 2026 to take possession (15 calendar days). If their destination requires relocating to another city, the deadline extends to August 27, 2026 (1 calendar month).

Before presenting themselves to their destination unit, they must take an oath to the Constitution in accordance with RD 707/1979. Only after this procedure can they formalize taking possession and begin receiving the remuneration for the level 24 position, which includes the specific allowance of 7,591.50 € annually (approximately 632.63 € gross per month in 12 payments, or less in 14 if distributed in extra payments).

A civil servant who accessed through internal promotion will occupy a level 26 position with a specific allowance of up to 13,829.34 € annually, which represents a remuneration improvement of up to 6,237.84 € per year compared to the level 24 of open access.

What should those affected do now?

1. Verify the appointment in the BOE (reference BOE-A-2026-16259, published July 27, 2026) and confirm that your name appears in the resolution.
2. Calculate your possession deadline: 15 calendar days from July 27 if you don't change location; 1 month if the destination implies change of residence.
3. Take an oath to the Constitution in accordance with RD 707/1979 before formalizing taking possession. Contact the HR unit of your destination organization to coordinate this procedure.
4. Formalize taking possession within the deadline before the competent personnel unit. Failure to do so within the deadline may have consequences on the effectiveness of the appointment.
5. If you disagree with the appointment conditions, you have 1 month to file a motion for reconsideration or 2 months to go to the National Court in administrative contentious proceedings.
6. HR units of the AGE: prepare registration documentation, coordinate constitutional oath and manage payroll entry with allowances corresponding to the assigned level (level 24 with 7,591.50 € or level 26 with up to 13,829.34 €).
