Foundations and associations linked to political parties with seats in the General Courts have guaranteed public financing for their operating expenses in 2026. The Royal Decree 852/2026, of October 21, published in the BOE on October 23, 2026 with reference BOE-A-2026-22082, regulates the direct granting of these subsidies and establishes the conditions under which they are distributed, controlled and sanctioned.
The regulation applies immediately: it enters into force on the same day of its publication. Any beneficiary entity must be aware of its obligations from that date.
What does this regulation establish?
Royal Decree 852/2026 regulates three essential aspects:
- Type of subsidy: Direct granting, under article 22.2.c) of the Law 38/2003, General Subsidies Law. This article allows bypassing competitive calls when reasons of public interest make that procedure unfeasible.
- Distribution criterion: Proportional to the electoral results of the general elections of July 23, 2023. The more seats obtained, the greater the subsidy received by the foundation or association linked to the party.
- Destination of funds: Operating expenses of beneficiary entities that carry out activities for the study and development of political and social thought.
The responsibility for managing these subsidies falls to the Ministry of Culture, supported by the cultural promotion competencies of article 149.2 of the Spanish Constitution.
External oversight is the responsibility of the Court of Auditors, which will audit both the accounting regularity of the contributions received and the expenses derived from them.
Economic and operational impact
For beneficiary entities, this regulation has direct consequences in two areas:
- Guaranteed financing: Direct granting eliminates the uncertainty of a competitive process. Foundations linked to parties with parliamentary representation know in advance that they will receive funds, the amount of which depends on their party's electoral weight in the July 23, 2023 elections.
- Control and justification obligations: In return, entities are subject to oversight by the Court of Auditors. This implies maintaining rigorous and separate accounting of income and expenses linked to these subsidies, and being prepared for external audits.
The applicable sanctioning regime is that of the Organic Law 8/2007, on political party financing. This sanctioning framework may result in fund repayment, disqualification from receiving public subsidies or financial penalties in case of irregularities.
From an operational perspective, management through the Ministry of Culture means that entities must channel their communications, justifications and payment requests through that ministry, not through other bodies.
Who does it affect?
- Foundations linked to political parties with representation in the Chamber of Deputies or Senate (General Courts) in the current legislature.
- Associations linked to political parties with representation in the General Courts that carry out activities for the study and development of political and social thought.
- Managers and executives of such entities, responsible for accounting justification before the Court of Auditors.
- Legal and financial advisors providing services to these entities, who must be aware of the sanctioning regime of Organic Law 8/2007.
- Ministry of Culture, as the managing and paying body for the subsidies.
It does not affect private companies, self-employed individuals or entities without accredited links to political parties with parliamentary representation.
Practical example
Imagine a foundation linked to a party that obtained 25% of the seats in the elections of July 23, 2023. Given that the distribution criterion is proportional to electoral representation, this foundation would receive approximately 25% of the total funds allocated to this direct subsidy program for 2026.
Once the funds are received, the foundation must:
- Allocate them exclusively to operating expenses related to activities for the study and development of political and social thought.
- Maintain separate accounting of these income and associated expenses, ready to be audited by the Court of Auditors.
- Comply with the obligations of Organic Law 8/2007 regarding transparency and financing, under penalty of the sanctions provided for in that regulation.
If the Court of Auditors detects irregularities in the justification of expenses, the entity could be forced to return the funds received and be disqualified from future public subsidies.
What should beneficiary entities do now?
- Verify accredited linkage with the corresponding political party and confirm that it has representation in the General Courts in the current legislature.
- Contact the Ministry of Culture to learn about the payment procedure and justification deadlines established for fiscal year 2026.
- Review internal accounting and ensure that there is a separate recording system for income and expenses linked to this subsidy, in preparation for oversight by the Court of Auditors.
- Update knowledge of the sanctioning regime of Organic Law 8/2007 on political party financing, especially regarding transparency obligations and cases of fund repayment.
- Document all activities financed with these subsidies, proving that they correspond to activities for the study and development of political and social thought, as required by the regulation.
Frequently asked questions
How is the distribution of subsidies calculated among foundations of different parties?
Distribution is proportional to the electoral results obtained in the general elections of July 23, 2023. The greater the number of seats obtained by the linked party, the greater the percentage of total funds corresponding to its foundation or association.
Why are these subsidies granted directly and not through competitive calls?
The regulation is based on article 22.2.c) of Law 38/2003, General Subsidies Law, which allows direct granting when reasons of public interest make the competitive call procedure unfeasible. In this case, the public interest is linked to cultural promotion recognized in article 149.2 of the Constitution.
What body oversees the use of these subsidies?
External oversight is the responsibility of the Court of Auditors, which will audit the accounting regularity of the contributions received and the expenses derived from them. The managing and paying body is the Ministry of Culture.
What sanctions can be applied if a foundation misuses these funds?
Beneficiary entities are subject to the sanctioning regime of Organic Law 8/2007, on political party financing. The consequences may include repayment of funds received, disqualification from receiving public subsidies and financial penalties, depending on the severity of the irregularity detected.
When does Royal Decree 852/2026 enter into force?
Royal Decree 852/2026 entered into force on the same day of its publication in the BOE: October 23, 2026. Obligations for beneficiary entities are enforceable from that date.
