Obtaining BEPI is a huge relief for any natural person who has gone through insolvency proceedings: personal debt is exonerated. But there is a very common mistake that can cost time and money: assuming that this exoneration also carries the cancellation of the mortgage in the Property Registry.
The Resolution of the Directorate General for Legal Security and Public Faith (DGSJFP) of July 6, 2026, published on October 22, 2026, makes it clear: BEPI extinguishes the personal liability of the debtor, but does not extinguish the registered real guarantee. The mortgage remains in the Registry until it is cancelled through the legal channels provided.
What does this resolution establish?
Two natural persons in insolvency proceedings attempted to cancel a mortgage from Banco Sabadell in the registry, arguing that the sentence exonerating unsatisfied liabilities (BEPI) had extinguished the guaranteed credit. The property registrar of Alcázar de San Juan no. 1 rejected the cancellation. The insolvent debtors appealed to the DGSJFP, which dismissed the appeal and confirmed the negative qualification note.
The central argument of the resolution is as follows:
- BEPI affects the personal liability of the debtor, but does not automatically extinguish the real guarantees registered in the Registry.
- To cancel a mortgage in the Property Registry, in accordance with articles 82 of the Mortgage Law and 174 of the Mortgage Regulation, one of these two enabling titles is required:
| Enabling title | Description | Is it sufficient? |
|---|---|---|
| Public deed of cancellation | Granted by the mortgage creditor (in this case, Banco Sabadell) | Yes |
| Final judicial resolution | Court order that expressly orders the registry cancellation | Yes |
| Private request from the debtor | Request or written submission presented by the insolvent debtor themselves | No |
| BEPI sentence without express cancellation ruling | Sentence exonerating unsatisfied liabilities without registry mandate | No |
The key is that BEPI and registry cancellation of the mortgage are two distinct legal effects. One operates on the personal level (the debt); the other, on the real level (the registered guarantee). The Property Registry can only act on the basis of formally enabling titles.
Economic and operational impact
For the insolvent debtor, the impact is twofold:
- The mortgage charge remains registered in the Registry even though personal debt is exonerated. This can block the sale or refinancing of the property.
- An additional procedure must be initiated to achieve cancellation: either negotiate with the bank (Banco Sabadell in this case, but applies to any entity), or return to court to request an express order.
- This additional procedure has costs in time and fees (solicitor, lawyer, notary or court fees) that the debtor had not anticipated when obtaining BEPI.
For property registrars, the resolution reinforces their qualification criteria: they can and must reject cancellations based solely on the BEPI sentence without express registry mandate.
Who does it affect?
- Natural persons who have obtained BEPI and have registered mortgages pending cancellation.
- Lawyers and solicitors who advise insolvent debtors in the post-BEPI phase.
- Property registrars who receive cancellation requests based on exoneration sentences.
- Financial entities as creditors (such as Banco Sabadell in this case) that may receive cancellation requests or negotiations regarding them.
- Notaries who must formalize cancellation deeds within the framework of post-insolvency agreements.
Practical example
Two natural persons obtain BEPI in their insolvency proceedings. They have a Banco Sabadell mortgage registered in the Property Registry of Alcázar de San Juan. They submit a private request to the registrar requesting cancellation, arguing that the BEPI sentence has extinguished the guaranteed debt.
The registrar issues a negative qualification note and rejects the cancellation. The insolvent debtors appeal to the DGSJFP. The DGSJFP dismisses the appeal and confirms that without a public deed from the bank or an express judicial order, the mortgage cannot be cancelled.
What options are left for them now?
- Option A: Go to the court that processed the insolvency proceedings and request that it issue an express order ordering the registry cancellation of the mortgage.
- Option B: Negotiate with Banco Sabadell so that it grants a public deed of cancellation before a notary.
Neither of the two options is free or immediate, but they are the only valid paths in accordance with articles 82 LH and 174 RH.
What should those affected do now?
- Review whether the BEPI sentence includes an express ruling on registry cancellation. If the order or sentence does not expressly order the cancellation of the mortgage in the Registry, it is not sufficient title.
- Request a supplementary order from the court. If BEPI is already final but does not contain a registry mandate, ask the court to issue an express order ordering the cancellation of the registered mortgage. It is the most direct and economical path.
- Negotiate with the mortgage creditor the cancellation deed. If the bank is willing to cooperate, the public deed of cancellation granted before a notary is equally valid. It may be faster if the creditor is willing.
- Do not submit private requests to the registrar. A request signed by the debtor is not a valid title for cancelling a mortgage. It only generates a negative qualification note and delays the process.
- Anticipate these costs in post-insolvency planning. Lawyer fees, solicitor fees, notary fees or court fees should be considered from the moment BEPI is obtained if there are pending mortgages.
Frequently asked questions
Does BEPI automatically cancel the mortgage in the Property Registry?
No. According to the DGSJFP Resolution of July 6, 2026, BEPI extinguishes the personal liability of the debtor but does not automatically extinguish the registered real guarantee. The mortgage remains in the Registry until it is cancelled by public deed of the creditor or final judicial resolution that expressly orders such cancellation, in accordance with articles 82 LH and 174 RH.
What documents do I need to cancel the mortgage after obtaining BEPI?
Only two titles are valid: (1) public deed of cancellation granted by the mortgage creditor before a notary, or (2) final judicial resolution that expressly orders the registry cancellation. A private request from the debtor or the BEPI sentence itself without express cancellation ruling are not sufficient.
How do I get the court to issue the mortgage cancellation order?
You must request the court that processed the insolvency proceedings to issue a supplementary order expressly ordering the registry cancellation of the mortgage. If the BEPI sentence is already final but does not contain that mandate, it is possible to urge the court to issue it. It is recommended to do so with the assistance of a lawyer and solicitor.
Can the registrar reject the cancellation even if I have the BEPI sentence?
Yes. The property registrar is empowered and obliged to qualify the titles presented. If the BEPI sentence does not contain an express ruling ordering the registry cancellation, the registrar may issue a negative qualification note, as the Property Registrar of Alcázar de San Juan no. 1 did in the case resolved by the DGSJFP.
What if the bank (mortgage creditor) does not want to grant the cancellation deed?
If the mortgage creditor refuses to grant the cancellation deed, the only alternative route is to obtain a final judicial resolution that expressly orders such cancellation. In that case, you will have to go to the competent court to obtain that judicial ruling.
